    5101:2-14-02               Application  for  professional  certification  as  a  type  B  home provider or in-home aide.

     

     

     

    (A)Individuals interested in professional certification as a type B home provider or in-home aide to provide publicly funded child care shall contact the county department of job and family services (CDJFS) to request an application for certification. The CDJFS shall accept and process all applications for professional certification as a type B home provider or in-home aide. The CDJFS may deny an application if the CDJFS determines that the applicant was previously certified as a limited or professional provider, and his/her certificate was revoked or the applicant voluntarily withdrew from the certification program as a result of CDJFS notification of its intent to revoke the certificate.

     

    (A)(B) An "application for certification" for the purpose of this rule shall mean require completion and submission of the following materials:

     

    (1)   ODHS 1643, JFS 01643 "Type B Family child Care Home and In-Home Aide Application;";

     

    (2)   ODHS 1280, JFS 01280 "Provider Medical Statement;";

     

    (3)   ODHS 1301, JFS 01301 "Child Care Convictions Statement" for the applicant, each adult residing in the type B home, and the provider's emergency/substitute caregiver;

     

    (4)   ODHS 1923 JFS 01923 "Emergency and Substitute Caregiver Statement;" and ;

     

    (5)   Bureau of Criminal Identification and Investigation (BCII) prescribed criminal records check form and standard impression sheet. Items necessary to complete the BCII criminal records check;

     

    (6)    At least three written references from individuals who are unrelated to the applicant and attest to the experience and ability of the applicant.; and

     

    (7)Verification of a high school diploma or GED, except for individuals certified before April 1, 2003.

     

    (B)Persons interested in being certified as a type B family child care home provider or as an in-home aide to provide publicly funded child care shall contact the county department of human services (CDHS) to request an application for certification. The CDHS shall accept and process all applications for certification as a type B home provider or in-home aide.

     

    (C)     When  the  CDHS  receives  a  request  from  an  individual  to  be  certified  CDJFS

     

     

    processes an application to certify an individual as a type B family child care home provider or as an in-home aide, the CDHS CDJFS shall schedule an interview. During the interview the CDHS shall and inform the applicant of the following:

    (1)    Procedures for review of the applicant's credentials and for inspection of the applicant's type B home, or the home of a child receiving in-home aide services:;

    (2)   Requirements and procedures for using an emergency and substitute caregiver;

    (3)   Information on completing the BCII prescribed criminal records check form and the standard impressions sheet for the applicant, adults residing in the type B home, emergency caregivers and substitute caregivers. Each individual is responsible for taking the forms to the county sheriff's office,  municipal police department, or other entity with the ability to make fingerprint impressions. Items necessary to complete the BCII criminal records check;

    (4)    Responsibilities of a certified type B family child care home provider or a certified in-home aide;

    (5)   Payment rates and collection of the copayment and fees from parents;

    (6)   Schedules and billing;

    (7)   Training and technical assistance for providers requirements and availability;

    (8)      Explanation  and  a  copy

    of  5101:2-14-01  through  5101:2-14-40  Chapter

    5101:2-14  of  the  Administrative  Code  and  any  additional  requirements developed by the CDHS CDJFS and prior approved by ODHS ODJFS; and

    (9)   Maintaining confidentiality of records governing families and children receiving publicly funded child day care.

    (D) The CDHS shall also provide the applicant with the following information when a determination is made that the applicant will be certified:

    (1) ODHS 1201, "Dental First Aid Chart;"

    (2) ODHS 8087, "Communicable Disease Chart;"

    (3) ODHS 1940, "First Aid;"

    (4) ODHS 1941, "Child and Adult Care Food Program Meal Requirements;"

    (5) All forms required to comply with the record keeping requirements contained in rules 5101:2-14-26 and 5101:2-14-28 of the Administrative Code.

    (E) The applicant shall complete and return the application for certification to the CDHS. An application will not be processed until all the following forms are received:

    (1) ODHS  1643,  "Type  B  Family  child  Care  Home  and  In-Home  Aide Application;"

    (2) ODHS 1280, "Provider Medical Statement;"

    (3) ODHS 1301, "Child Care Convictions Statement" for himself and each adult residing in the type B home;

    (4) ODHS 1923, "Emergency and Substitute Caregiver Statement;"

    (5) BCII prescribed criminal records check form and standard impression sheet for the applicant and each adult residing in the type B home.

    (6) At least three written references from individuals who are unrelated to the applicant and attest to the experience and ability of the applicant.

    (F)(D) Upon filing of an application for certification, the applicant must agree to cooperate with the CDHS CDJFS investigation and to meet all requirements contained in Chapter 5101:2-14 of the Administrative Code. These requirements apply to all certified type B homes providing care that is privately or publicly funded.

    (G)(E) The CDHS may contract with or issue a certificate for authorization for payment (COAP) for a provider certified by another CDHS. The CDHS CDJFS shall not require an applicant to complete the certification process when the applicant is already certified as a type B family child care home provider or as an in-home aide by another CDHS CDJFS.

    (H)(F) An individual may not applying to be certified by the CDHS CDJFS as a type B family child care home provider or as an in-home aide if the provider is not shall be a resident of the state of Ohio.

    (I) After a provider voluntarily withdraws from the certification program as a result of CDHS notification of its intent to revoke the provider's certificate or after denial or revocation of a certificate, an individual seeking certification shall submit a new application. The new application shall be submitted no earlier than one year after the date in which his certificate was revoked or one year after the date in which the provider withdrew from the certification program.

    (J)(G) In accordance with division (B) of section 5104.99 of the Revised Code, whoever withholds information from or falsifies information on the ODHS 1301 JFS 01301, "Child Care Conviction Statement" in violation of division (B) of section 5104.09 of the Revised Code is guilty of a misdemeanor of the first degree.
