5101:2-14-16 Group size for professional certification as a type B home provider or in-home aide.
(A) The type B home provider may provide child care for no more than six children at any one time, unless the caretaker of a child(ren) is also present in the home, and that child(ren) shall not be included in the total of six. In determining the total number of children who may be in care:
(1) No more than three children may be under two years of age;
(2) Children under six years of age, and related
or not relatedto the provider,mustpursuant to paragraph (Z) of rule 5101:2-14-01 of the Administrative Code, shall be included in the total of six;(3) Children
, up tounder fifteen years of age andarenot related to the provider,mustshall be included in the total of sixunless their caretaker parent ispresent;(4) Children six years of age up to
thirteeneighteen years of age andarerelated to the provider, pursuant tothe definition contained inparagraph(W)(Z) of rule 5101:2-14-01 of the Administrative Code, and for whomthe CDHS isreimbursing the provider for provision of employment and training publiclyfunded child carecare is privately or publicly funded,mustshall be included in the total of six;(5)
Children up to eighteen years of age and including those who are related to theprovider, pursuant to the definition contained in paragraph (W) of rule5101:2-14-01 of the Administrative Code and for whom the CDHS isreimbursing the provider for provision of special needs or protective publiclyfunded child care, must be included in the total of six; and(6)
Children six years of age or older who are related to the provider who do notreceive publicly funded child care do not need to be included in the total ofsix.(B)
The total of six must include all children as outlined in paragraph (A) of this rule,including children who are on the premises of the type B home and whose parentsare not also present, whether or not the provider receives reimbursement for thecare of these children.(C)(B) Thecertifiedtype B home provider may care for children whose care is not publicly funded. The providermustshall notify theCDHSCDJFS of the hours of care, names, ages and the number of all children receiving care. When hours of care change, the providermustshall notify theCDHSCDJFS prior to the child's first day of attendance or on the next working day following the change.(D)(C) Except for paragraph(E)(D) of this rule, thecertifiedin-home aide may not provide child care services for any children other than thecaretaker parent'scaretaker's while in thecaretaker parent'scaretaker's home, and shall only care for publicly funded children whose child care services have been approved by theCDHSCDJFS. TheCDHSCDJFS may approve child care services to be provided by an in-home aide to any number of thecaretaker parent'scaretaker's publicly funded children who reside in the home.(E)(D) With the agreement of the caretaker,Thethe in-home aide may bring no more than two of his/her own children to thecaretaker parent'scaretaker's home while providing child care services.In order for the in-home aide to bring his ownchildren to the caretaker parent's home while child care services are provided, thecaretaker parent shall grant his consent.Effective: 04/01/2003
