NOTICE OF PUBLIC HEARING

Notice is hereby given that the Board of Building Standards will convene for a public hearing in accordance with Chapter 119. of the Revised Code, at 10:00 A.M., Friday, May 2, 2008 in Hearing Room

#1, at 6606 Tussing Road, Reynoldsburg, Ohio, 43068. The purpose of the hearing is to consider rules of the Administrative Code, identified as Amendments Group LXXX of the Ohio Building Codes, proposed pursuant to Chapters 119., 3781., 3791., and 4104. of the Revised Code.

Synopsis of the proposed rules:

PART A

Consider the following new rules of the Administrative Code certifying building departments to enforce the Residential Code of Ohio: 4101:2-81-38 village of Pleasant Plain; 4101:2-81-39 village of Leetonia

PART B

Consider the following amended and new rules of the Administrative Code certifying building departments to enforce the Ohio Building, Mechanical, and Plumbing Codes and the Residential Code of Ohio: 4101:2-70- 14 village of Boston Heights; 4101:2-70-69 city of Mayfield Heights; 4101:2-70-88 city of Norwood; 4101:2- 71-26 city of Whitehall; 4101:2-71-87 village of LaGrange; 4101:2-72-62 city of Munroe Falls; 4101:2-72-75 city of Ontario; 4101:2-73-01 city of Wadsworth; 4101:2-75-24 village of Westfield Center; 4101:2-76-81 village of Lithopolis; 4101:2-77-31 village of Castalia; 4101:2-77-32 Prairie Township, Franklin County; 4101:2-77-33 village of Carroll; 4101:2-77-34 Mercer county; 4101:2-77-35 city of Celina; 4101:2-77-36 village of Coldwater; 4101:2-77-37 village of Fort Recovery; 4101:2-77-38 village of Montezuma; 4101:2- 77-39 village of Rockford; 4101:2-77-40 village of St. Henry; 4101:2-77-41 village of Burkettsville; 4101:2- 77-42 village of Mendon; 4101:2-81-03 village of Baltimore.

PART C

Consider proposed rescission of the following rules as a result of duplicate rules being filed for these jurisdictions: 4101:2-77-30 village of Baltimore (correct rule 4101:2-81-03); 4101:2-81-33 village of Newtown (correct rule 4101:2-72-69); 4101:2-81-19 city of Cinnamon Lake building department filed in error.

PART D

Consider the following amended rule of the Ohio Building Code: 4101:1-35-01 to allow the use of the 2003 in lieu of the 2006 IECC and the 2005 in lieu of the 2008 NEC for one-, two-, and three-family dwellings.

PART E

Consider the following amended rule of the Ohio Mechanical Code: 4101:2-15-01 to allow the use of the 2005 in lieu of the 2008 NEC for one-, two-, and three-family dwellings.

PART F

Consider the following amended rule of the Ohio Plumbing Code:  4101:3-13-01 to allow the use of the 2005 in lieu of the 2008 NEC for one-, two-, and three-family dwellings.

The full text of the proposed rules are filed electronically with the Secretary of State, the Legislative Service Commission, the Joint Committee on Agency Rule Review, the Department of Aging, and the Small and Developing Business Division as required in sections 119.03 and 121.24 of the Revised Code. The required rule filing can be viewed on the Register of Ohio (http://www.registerofohio.state.oh.us). Additionally, the Clerks of the 88 County Commissioners are notified of the filings as required by statute.
