NOTIFICATION OF PUBLIC HEARING

Notice of hearing

to rescind Rules 4501:3-1-01, 4501:3-4-01, and 4501:5-1-01, and

to adopt new Rules 4501:3-1-01, 4501:3-4-01, and 4501-3-01 of the Ohio Administrative Code in accordance with

Chapter 119. of the Ohio Revised Code

 

Notice is hereby given that a hearing will be held by the Ohio Department of Public Safety for the purpose of considering the proposed rescission and the proposed adoption of the above-listed administrative rules.

 

Based on a Revised Code section 119.032 review and as authorized in Section

5502.25 of the Ohio Revised Code, the Department of Public Safety proposes to rescind existing Rules 4501:3-1-01 and 4501:3-4-01 and to replace them by adopting new Rules 4501:3-1-01, and 4501:3-4-01 of the Ohio Administrative Code. These rules govern the Ohio Emergency Management Agency Division of the Ohio Department of Public Safety. The purpose of a proposed change to Rule 4501:3-1-01 is to relocate language concerning notice of public hearings regarding rulemaking to a common rule with requirements that are applicable for all Department of Public Safety divisions. Proposed changes to Rule 4501:3-4- 01 entitled "Emergency management funding," are to update the rule by deleting reference to "The Robert T. Stafford Disaster Relief and Emergency Assistance Act" which is no longer the statutory authority for federal  emergency management funding and to enhance consistency within the rule by replacing "will" with "shall" and replacing "emergency management" with "Ohio emergency management agency."

 

As authorized in Sections 4749.02 and 5502.011 of the Revised Code, the Department of Public Safety proposes to rescind existing Rule 4501:5-1-01 and to adopt new  Rule 4501-3-01. This proposed change is for the purpose of relocating a common rule addressing notice of Department of Public Safety public hearings on proposed rulemaking to a location more readily apparent as applicable to all divisions with the Department.

 

A public hearing on the proposed rules will be held Tuesday, October 3, 2006 at 10:00 A.M. in room 109 (first floor) of the Charles D. Shipley Building, Ohio Department of Public Safety, 1970 West Broad Street, Columbus, Ohio.

 

Either written or oral testimony will be received at the hearing. Additionally, written comments received at the address below before the hearing will be treated as testimony.
